A federal appeals court is rehearing a request to dismiss the case against and former Trump national security adviser Michael Flynn.
Flynn admitted he lied to the FBI during the investigation into Russia’s 2016 election interference.
He pleaded guilty and was set for sentencing.
Then, in a controversial move, Trump’s Attorney General William Barr asked to have Flynn’s charges withdrawn.
Barr’s Justice Department argues the FBI shouldn’t have interviewed Flynn and therefore Flynn shouldn’t have been charged for lying to them.
Earlier this summer, a circuit court ordered Flynn’s case dismissed.
The D.C. Circuit Court of Appeals wiped out the lower court ruling and will now rehear the arguments.
It is unlikely a ruling will be issued today.
